MahaRERA Grants Four-Month Extension to Real Estate Projects on Account of Force Majeure

MahaRERA, by its Order No. 66 of 2026 dated 7 August 2026, has granted a four-month extension to certain registered real estate projects in Maharashtra on account of the prevailing situation in West Asia being treated as a force majeure event. The Order has been issued under Section 6 of the Real Estate (Regulation and Development) Act, 2016, which permits extension of project registration in cases of force majeure.

The Order follows an Office Memorandum issued by the Ministry of Finance, Government of India on 29 April 2026, which treated the prevailing West Asia situation as a “War” for the purpose of invoking force majeure. Subsequently, the Ministry of Housing and Urban Affairs, Government of India, by an advisory dated 31 July 2026, advised State Real Estate Regulatory Authorities to grant a four-month extension to registered projects affected during this period.

Accordingly, MahaRERA has provided that registered projects whose completion date, revised completion date or extended completion date falls on or after 28 February 2026will receive an extension of four months. However, projects registered on or after1 August 2026 are excluded from this benefit.

Importantly, the extension will be granted automaticallyand promoters are not required to make separate applications. MahaRERA’s Registration and IT Cell has been directed to update its records and the MahaRERA portal to reflect the extension.

Accordingly, MahaRERA’s Order No. 66 of 2026 provides a uniform four-month extension to eligible registered projects in Maharashtra whose completion, revised completion or extended completion dates fall on or after 28 February 2026, while excluding projects registered on or after 1 August 2026.
